"Those who profess to favor freedom, and yet depreciate agitation, are men who want crops without plowing up the ground. They want rain without thunder and lightning. They want the ocean without the awful roar of its many waters." —Frederick Douglass

If men were angels, no government would be necessary. If angels were to govern men, neither external nor internal controls on government would be necessary. (James Madison)

"Young man, what we meant in going for those Redcoats was this: we always had governed ourselves and we always meant to. They didn't mean we should."
(Captain Levi Preston, of the Danvers militia, at age 91, remembering the day)

That it is an indispensable duty which we owe to God, our country, ourselves and posterity, by all lawful ways and means in our power to maintain, defend and preserve those civil and religious rights and liberties, for which many of our fathers fought, bled and died, and to hand them down entire to future generations.  Suffolk Resolves, September 9, 1774, attributed to Dr. Joseph Warren

Read the decision/opinion.  It's immediate effects are small, and the State can drag it on for years, but they have no alternative but to appeal to the supreme court. If not California has to go to open carry (loaded open as opposed to the unloaded open that they where before) or to Shall Issue.

The opinion is overly documented as if the Judge felt this was going to the supreme court.

All in all a day of sunshine for a state that has had nothing but sleet as far as gun laws goes. As far as climate of liberty goes they are still at -30 degrees.

I do hope you get some real soft rain soon though not a ton of flooding. Drought in the central Valley would devastate the area.
There are many things talked about that make the people of the US
different; being riflemen is one, asking why is another, as is getting
what needs doing done.

The Ninth is run by Alex Kozinski, perhaps the greatest believer in liberty on the federal bench -- and the most passionate supporter  of the Second Amendment.

It was written to lay the groundwork for reform and to withstand appeal. The decision goes beyond the single issue of concealed carry and puts it in perspective of the broader RKBA.  It's a good step for the people of California and a slap in the face to the imperial leaders who seek to deny citizens their Constitutional rights.

The Second Amendment is a doomsday provision, one designed for those exceptionally rare circumstances where all other rights have failed -- where the government refuses to stand for reelection and silences those who protest; where courts have lost the courage to oppose, or can find no one to enforce their decrees. However improbable these contingencies may seem today, facing them unprepared is a mistake a free people get to make only once.

-- Justice Alex Kozinski, US 9th Circuit Court, 2003
