Draconian laws proposed in NY

Among others, backrgound checks for ammo purchases, mag limit of 7, no one allowed to transport more than 5 firearms. The governor is PUSHING this.

I spent a good deal of time with Senator Marchione and Assemblyman McLaughlin at the gun show this weekend; this is what HAS to happen:  Calls need to go to your local reps, yes, but Governor Cuomo's office as well, with the following: No new restrictions on gun freedom, No limitations on magazine capacity, No limitations on how many firearms we may transport, AND -THIS IS THE KEY PART-  NO usage by the governor of the "MESSAGE OF NECESSITY" attached to ANY of this legislation. This is the method he will be using to get this pushed through on a fast track, and the legislators probably  won't even read the bill before voting.

NRA-ILA is advising that the New York State legislature may attempt to ram all of Governor Cuomo's gun control proposals through the legislature on this coming Monday. NRA's lobbyist is currently in New York doing everything he can to delay the vote as long as possible, so it is imperative that every concerned gun owner mobilizes and takes immediate action.

These proposals apparently will include the most restrictive ban on semiautomatic rifles and shotguns in the nation; bans on standard-capacity rifle and pistol magazines (i.e., those holding more than ten rounds -- maybe even fewer); bans on internet ammunition purchases; background checks for ammo purchases; and other draconian gun control laws. Though the actual bills have not yet been seen, Gov. Cuomo stated in an interview that confiscation is an option, meaning that the new bans may not have a "grandfather clause" that allows current owners to keep the guns that they now have.

Please notify your friends, neighbors, fellow club members, hunting buddies, and Second Amendment supporters that they need to call their representatives in the Senate and Assembly today!

First, it is essential to contact the state Senate Majority Leader, Sen. Dean Skelos, and tell him that the Senate Republicans must not make any concessions on gun control. His office number is 518-455-3171.

well, they rolled up all this junk in one new bill, 2230, and shoved it through. No assault rifles, but we'll have to wait to find out what they are, and nothing over 7 shot mags. It's a sad day, for sure. Not even close 43-18 vote. Only 2 spoke against it, Kathy and one other.

The provisions discussed in private conferences were confirmed to The Associated Press by five officials, Republicans and Democrats, in the Assembly and the Senate. The proposals would:

--Further restrict assault weapons to define them by a single feature, such as a pistol grip. Current law requires two features.

--Make the unsafe storage of assault weapons a misdemeanor.

--Mandate a police registry of assault weapons.

--Establish a state registry for all private sales, with a background check done through a licensed dealer for a fee, excluding sales to immediate relatives.

--Require a therapist who believes a mental health patient made a credible threat to use a gun illegally to report the threat to a mental health director who would then have to report serious threats to the state Department of Criminal Justice Services. A patient's gun could be taken from him or her.

--Ban the Internet sale of assault weapons.

--Restrict ammunition magazines to seven bullets, from the current 10. Current owners of higher-capacity magazines would have a year to sell them out of state. An owner caught at home with eight or more bullets in a magazine could face a misdemeanor charge.

--Require that stolen guns be reported within 24 hours. Otherwise, the owner would face a possible misdemeanor.

--Increase sentences for gun crimes including for taking a gun on school property.

--Limit the state records law to protect handgun owners from being identified publicly. The provision would allow a handgun permit holder a means to maintain privacy under the Freedom of Information law.

Better start emailing and calling the members of the NYS Assembly because that is the stop! After that it is a quick trip to the governor's desk for his signature and implementation ("MESSAGE OF NECESSITY").

The march on Albany this coming weekend may be too late because "MESSAGE OF NECESSITY" has been invoked.

It is interesting that they exempted .22 tube fed rifles from the ammunition capacity ban but not .22 magazine fed rifles. I guess that tube fed rifles are going to become the typical and customary rifle at Appleseed's in New York.

The NYS Assembly is now in session. Support for the gun control legislation is very strong. Call!!!!

NYS Assembly passed the bill 104-43 and the governor signed it into law at 5:10pm.


Folks, we have just lost our 2nd Amendment in NYS.


Rifles will have a "one feature" test. If the rifle passes that "one feature" test, it is banned.

Registration is mandated, and owning a registered rifle is subject to approval, or denial of ownership which would be confiscated.

Possibly ammo sales will be limited to businesses in NY (no Internet sales) if I am reading section 50's summary correctly.

Which means sales of ammo and mags will rocket, along with the prices via dealer inflated prices. Get 'em while you can. Rifle sales too but be ready to register them.

Because the governor invoked "MESSAGE OF NECESSITY", this prevented the general public to get fully involved. Its being reported in the news that the president is seriously considering using executive order(s) for gun control and gun ban. Which is this tyranny or despotism?

IMO this may be a political move, but she is sincere and dedicated to the 2nd A. cause. Please join her.

Also lets see if we can get the NRA, GOA, JPFO, RKBA and others to file something in federal court about this state law stripping NYers from their Constitutional rights.

IMO I think NYS is a "test bed" about any kind of ban laws for which the president and the congresscritters are watching. I do think there may be at least one executive order issued on gun control/ban and that will cross the line to being illegal (in other words using an exec order beyond the scope of his authority).

Folks, we have just lost our 2nd Amendment in NYS.

Natural rights, by definition, cannot be lost or taken away.
An unconstitutional law is, by definition, an invalid law.
Thus, it is not binding upon the otherwise law-abiding citizen.
The right to keep and bear arms is a natural right.
Therefore, the main effect of these laws may be to drive law-abiding citizens underground.

The secondary effect of these laws will be to further embolden other tyrants and despots to try to spread such laws beyond NY. This is the immediate risk that we ALL must face together, if we are to save NY.

The tyrants and despots can control us in the short term, but they will be unable to maintain their hold, because each desperate act they make helps us to awaken ever-more sleeping Americans.

Even if we fail to overturn this law quickly, the citizens of the once-great state of New York will have a year to deal with many of the personal consequences. Those unwilling to hide, sell, or register their firearms will have several other options, such as using trusts to own and store them outside of NY's jurisdiction, or seeking fellow patriots willing to accept a temporary transfer of possession and responsibility for safe storage, until these illegal laws can be overturned, and the property returned to their rightful owners.

But all of that is still many months away. Despite our shock or dismay, the current fight has not changed. We still have a nation to save. We must save our nation, if we are to save the citizens of NY. Keep on bailing!

Sorry for my brothers and sisters in nys.  In a lot of ways WI and NY are the same.  One difference is our governor did not foam at the mouth about gun control. And believe me, we have plenty of gun deaths in Milwaukee .
