Attention NM Appleseeders.
This is our Virginia Rally!!
Pro Gun Women and the New Mexico Shooting Sports Association are the sponsors.
January 31 Pro Gun Rally in Santa Fe at the Merry roundhouse starting at 11 AM. Appleseed flags, shirts are naturally welcome as this event is about networking with all other firearms and liberty minded groups.  If you did not make it last year at this time PLEASE be here this time if at all possible. We need big numbers this time.

As you know our last elections were financed by 1.) Soros, 2.) Bloomberg and since we border Mexico, 3.) The cartels. 
Additionally, at the last minute some ballots were "mysteriously" discovered which swayed the the election and thus for the first time in decades our political trifecta is completely dominated by extreme factions voted in within the Democrat party.
This is the same gaggle of tyrants that have been financing the various NM gun bills for the last 5 years or so. Thus:

Red Flag Laws, semi auto ban and magazine bans that did not get passed last time, due to the fact they ran out of time, is up on the agenda again.
The New Mexico 30 Day Legislative Session will include most gun control bills not passed last session.
Our last Pro Gun rally was cancelled to to extreme pro 2A factions who wanted to hijack and blend our peaceful message for their own.

Arrive 10:30 - 11, Rally Starts at 11 at the roundhouse. Give yourself time to park and walk. Parking is usually far from the roundhouse.

This is an outdoor rally so dress warm.
There will be speakers, but we will keep it brief for inclement weather. Then we will march around the roundhouse and then up to the Governor's office to present her with No Red Flag Signatures.

Please make yourself visible inside the roundhouse - walk around, go visit the office of Representatives and leave them messages. Being SEEN inside is very effective.

And this one might ruffle some feathers - but please, leave your long guns at home and just carry how you normally would. We want them to hear our MESSAGE not dismiss us because they are afraid. They need to fear the message, not us. Dress normal, be normal, just be louder than usual :-)
Open carry is not allowed in the roundhouse, and for now, you CAN conceal carry inside.

Just remember - we want them to see the numbers and hear the message. Guaranteed that if anyone shows up dressed in all camo gear and body armor with an AR - that person will make the news only, and it won't be good news either. So please, just dress in your normal day to day clothing. And if you feel differently, I invite you to make your own rally. Thank you."

This is why it's SO important for us to show up at the Second Amendment Rally!
Moms Demand Action will be bussed to the roundhouse in big numbers and they WILL go and talk to their legislators. We need to do the same! YOU are the voice of New Mexico, not them!
Right after the rally, make sure you go see your personal representatives, as well as those presenting these gun confiscation GeorgeSoros and mini Mike Bloomberg have been very intent on BUYING THIS STATE! 

GeoSoros owns our governor, MLG, the SOS, and the District Attorney from Bernalillo.  GeoSoros's PAC is New Mexico Peace and Justice. 
The Santa Fe New Mexican put it on the front page that Soros donated to MLG.

When:
January 31, 2020, at 11:00 am, outside on the East Side of the Capitol Building.  (Get there early to park)

Why a Weekday?
1) So the legislators see us.
2) So we can go inside and talk to our representatives or at least show up in their offices and leave a message.

Where:
State Capitol in Santa Fe  490 Old Santa Fe Trail, Santa Fe, NM 87501

Can I Open Carry?
Outside, yes.
Inside the State Capitol is concealed carry only.

Pro-Gun Women suggests you dress how you usually dress, carry how you typically carry. However, you are your own person and free to do what you want. Just remember, we will be under media scrutiny.

Parking:
Parking is challenging at the State Capitol.
There is a Capitol Parking Lot just to the east of the roundhouse on Old Santa Fe Trail, but it hit or miss for parking. It is a 4-minute walk to the roundhouse.
The State Capital Parking Building at 485 Galisteo St, Santa Fe, NM 87501, and it is a 7-minute walk to the roundhouse.
Public parking is available at the Sandoval Municipal Garage 216 West San Francisco Street (across the street from The Lensic). It is a 12-minute walk from the Capitol.
Additional metered parking is available throughout the downtown area.

Transportation:
There are buses and the RailRunner train that will take you to the capital, HOWEVER - no weapons allowed open or concealed.
Carpooling with others is a great suggestion, especially if you have issues walking. You can be dropped off right in front of the roundhouse.

Weather:
It's New Mexico in January, so it could be snowing, hailing, windy, cold, raining, cloudy, sunny, warmish, or all of the above. Dress in layers.

Goal:
Peaceful assembly of gun owners who are TIRED of the New Mexico Representatives and the Governor taking our gun rights away. If you are looking for trouble or a physical fight, this is not the rally for you. Let's be the shining example of good behavior! This rally is open to all!

Plan:
Assemble on the east side of the State Capitol Building. Please give your self plenty of time for parking and walking. Around 11:00 am we will start the rally. After, we will do a walk around the roundhouse to make sure we are seen from all angles. Then we will go inside (remember, no open carry in the building), and you are welcome to go to the Governor's office to deliver some petitions with Pro-Gun Women, or you can find your Representatives office and encourage them to protect the Second Amendment. We will also go to the top ten anti-gun reps and tell them to vote no on gun bills. Remember, be calm, be respectful. We are gun owners, not violent left-wing fanatics

We do not anticipate any trouble from anyone; however, always be aware of your surroundings walking to and from the rally. Walk together in groups to and from the event, if possible. There will be state police monitoring the event.

Any form of hate group will not be tolerated and asked to leave

Anyone looking to start trouble should not even bother coming

It has begun, we finally have the committee assignments for the Redflag SB5 Bill.
We need to contact each of these Senators and express politely, our displeasure of this bill.
Below are some talking points brought up by Sheriff Mark Cage, that will help you explain why this bill is bad.

Besides the blatantly obvious lack of due process, the lack of addressing mental health issues that are the actual root of the problem, and the whole "Minority Report" mentality, I have identified several other flaws that prove how shoddily this bill was slapped together.

1) The bill states that the court shall issue a search warrant to be executed. The process for obtaining a search warrant is that a law enforcement officer petitions the court through an affidavit and the court determines probable cause and approves or disapproves it. Who will be petitioning for this search warrant? The court itself? Not how things work.

2) It specifically states that law enforcement may not charge storage fees for the firearms and ammunition. This is a minor issue, but this is just another unfunded mandate.

3) When defining the temporary order, the bill refers to "probable cause" which is the standard held for searches, arrest warrants and warrantless arrests. However, when it comes to issuing a 1 Year extension on the seizure it requires the much lower standard of "preponderance of the evidence". Why the much lower burden of proof when it comes to a much longer infringement of a citizen's right to bear arms?

4) The bill states law enforcement may dispose of (sell) seized firearms and ammunition after a certain time period. This flies in the face of New Mexico forfeiture law that was championed by these same people that didn't want us to seize drug dealers guns and convert them to help fund drug enforcement operations. But it's ok if it's a citizen that hasn't committed any crime. Just not a drug dealer...

5) The potential for abuse by malicious ex partners has been spoken of frequently by many sources is this, Further room for abuse is provided in this bill by prohibiting law enforcement from charging for reports, pictures and videos used to bolster the case against the gun owner by the accuser. We spend a significant part of our budget and our office staff's work week providing these items to citizens, attorneys, businesses, etc. and HAVE to charge fees to at least partially recoup our expenses.

6) Another issue from the Bill is under the definition of "firearm". Assuming we were to agree with the seizure of the gun itself, why would we need to also seize accessories like a suppressor?

Have no doubt, red flag laws are the first, frightening steps in a massive, government-controlled, gun-confiscation movement. Our Founding Fathers rebelled against England for far less.


Civic responsibility is what we teach, here is the simplest and fastest way to get in touch with our reps in the post above.

For a quick call/email:
"My name is ____ and my zip code is ____, and I am a resident of New Mexico. I want _____ to vote NO on SB5."

Follow up with an email that says the exact same thing. Easy.

Trust me, they don't have time to read long-winded emails, and the secretary doesn't have time to hear your story.

All they need to know is you want them to vote NO on this bill.

This is very effective!
Time is short and we have little time to save our states...and our nation's for that matter,  firearms liberties!

Redflag bills are now introduced in the 2020 New Mexico Legislature. Committee assignments are being doled out and our battle has officially begun.
Redflag laws, otherwise known as Extreme Risk Protection Orders (ERPOs), whatever you choose to call them, are supposed to give the ability to call law enforcement and stop a bad guy with a gun before he hurts someone. That sounds a lot like a script for a cop tv show than what really happens in real life. In reality, these laws are designed for abuse by ex-partners, family members that disagree with your 2A rights and more.

We've even seen people killed during so-called Redflag raids and no-knock raids. At the very best of the orders, innocent individuals are faced with having to pay tens of thousands of dollars, to restore their rights to own and possess firearms, even when the order was abused and false.

Would you call that the price of owning firearms, or an abuse of the law, possibly even for political gain. Many of these politicians pushing for Redflag laws, are using the push for their popularity gain and to increase their campaign income. They can even be considered a grab at power, to circumvent our God Given Rights to defend ourselves and family. But these laws are unlikely to truly address the issues of crime and mental health.

How do you know someone will be violent, how often have you seen someone commit a crime and later wondered how they fell through the cracks, with no one noticing their intentions. Yes, there have been times we all have seen that local kid get arrested and we said, "We knew that kid was headed for trouble". But we forget all the times we see an incident and think, "I never knew there was an issue". We always can hope we are right, but all too often we aren't.

There are real cases where family members will have legitimate concerns, even doctors may recognize a real concern. We often see in hindsight, family members saying they knew someone needed help, but for one reason or another, it wasn't acted upon.

Doctors and judges process many people through their practices, they are trained highly and have much experience, exercising their judgment. You would think they would be in an excellent position to predict if one of their clients poses a real violent risk. But in practice, even they fall short on predicting who and who will not be a risk. Their track record is severely lacking in this area.

Looking at mass murders during the recent 20 years, we can see there is nothing quiet about their mental conditions. Over 60% of them received mental health/psychiatric counseling. The majority of them had prior contact with law enforcement also. But in all these years, almost none of them were ever adjudicated as a violent risk to themselves or others. And that poor track record falls even worse when applied to ordinary people.

Doctors in clinical settings, often have to assess the risk of patients, with only a 60% accuracy of the next 24 hours. That is only slightly better than the 50/50 odds of guessing. But now we want to let non-mental health professionals make that determination.

How many of you have an ex-partner, family member or even a parent of an ex-partner, that you disagree with. They are the ones that get to make that mental health risk assessment on you under Redflag Laws.  They can file a report on you, stating that you are a danger to yourself or others, triggering an ex-parte order from a court, to flag you as a risk and allowing for confiscation of your firearms. Disarming you with basically a phone call, and often without consequences to themselves for making a false report.

Where is your due process that is guaranteed by the US Constitution. Redflag Laws give way to firearms confiscation base solely on an accusation. You are not given a chance to present any facts or proof on your behalf. In fact, this all happens before you are aware of it.

Domestic abusers can use this law to disarm their innocent partners, confiscating their tools of self-defense. They are left totally vulnerable and protected only by a piece of paper, along with the hope that law enforcement can arrive in time to save them.
A vindictive spouse can use Redflag Laws in a divorce. Do you trust a lawyer not to advise their client to use this route to harass and undermine their spouse. What about that family member that disagrees with you on firearm ownership and the right to bear arms? They can use this to cause you to lose your firearms and further cause grief. What about that relative that you have an argument on social media with, they will now have a tool to harass you legally.

A majority of firearms owners are upright and law-abiding. In fact, studies have recently shown that Licensed Concealed Carriers are among the most law-abiding people there are, even more so than law enforcement according to studies. So who are we making safe, when we disarm the most law-abiding people around.
Yes, we want to disarm people who make threats. But there are already laws available to do that. Even the ACLU has said they have great concerns with Redflag Laws violating due process.

Oh, and don't forget, this judgmental order, is not in criminal court, so you have no right to a public defender. If you choose to fight the order, you will have to foot the bill for your attorney. Attorneys I've spoken to have said a $15,000 to $20,000 bill for defense is not unthinkable.

So, there you can see, Redflag Laws don't truly protect you, but instead can be used to abuse your rights. They will cost many thousands of dollars to defend yourself and are based solely on a statement of an accuser, that you have no right to defend against till afterwards.

Do you think politicians are acting in your best interest and true public safety when they vote for Redflag laws, the obvious answer is no. They use the media to hype up their stance for the laws, drawing in support and money for their re-election campaigns. They sensationalize violent crime and shout that we need to do something about it, but even when 29 or 33 Sheriffs in New Mexico tell the politicians that this law is bad, it falls on deaf ears.

So please, educate yourself on what Redflag Laws truly are. Talk to your local County Sheriff about it. And then let your Legislators know what a bad bill it is and you DON'T WANT IT!

SB5, the first red flag bill, the "extreme risk" gun confiscation bill will be heard in its first committee, Senate Public Affairs, on Tuesday the 28th. The committee meets in Room 321 starting at 2:30pm. The committee is also hearing the recreational marijuana bill on the same day; we don't know what order the bills will be heard in yet, but expect that the committee meeting will be long.

To get a seat you MUST arrive early!

UPDATE!!!  The hearing on SB05 has been MOVED to Tuesday, January 28, at 1:30pm on the Senate Floor in Santa Fe!  Coincidence?  I sincerely doubt it!  I think they're scared of another showing like Richmond.

For folks unable to be in Santa Fe, there will be a sister rally in Las Cruces, NM the same day!

Remember:
They banned firearms in the gallery, unlike last year, where it was still open carry.
This means you have to leave your firearm in your car while you walk the 15 minutes to the roundhouse or have a friend outside.
They are playing hard ball and running scared.

SB5 passed with flying colors along party lines as predicted. :-[
Only 7 people on our side were allowed to speak.
Then at the last minute they moved back the time by one hour to throw a wrench into
the works to the folks who would have been there at the appointed time.

Worst news is the New Mexico State Police will support Red Flag laws. :wb:

I can't say I'm surprised, but I'm certainly disappointed.

In the plus column, the NM Sheriff's Association and the Albuquerque Police Officer's Association have both officially condemned that resolution. The Dona Ana County Commission defeated a resolution to support that legislation yesterday, also.

HB 5 is being heard today at 2:30 pm in room 321.
Here is a list of things to do if you are going to the Capital and for the majority of those who can't make it today, lets hit the phones and emails.
If you are going today and you have never been to the capitol:
Arrive EARLY! Moms are shipped in from all over to fill up the seats so we cant talk. Give yourself ample time to park as well. It snowed yesterday, and the sidewalks and parking lots are icy. The high will be in the '20s. Be careful and dress warmly.
When you enter the roundhouse, you are on the second floor. Go up one floor to find the Senate Judiciary Committee meeting.
No hats allowed in the committee meetings. Cell phones off. No videos or pictures. No clapping or making noise.
They are only going to allow a FEW people to speak. If you get picked, make sure you have a very clear, concise, 1-2 minute speech planned. But don't be surprised if they only allow 2-3 people to talk.
Moms come in BIG numbers - we need to be there in big numbers as well.
ALSO - if you have time before or after, there is a sheet you can sign in every person's office. I HIGHLY recommend you visit every one of their offices and tell them to VOTE NO ON SB 5! Remember - the secretaries DON'T represent the senators, so please be kind. If you are rude, I will find out about it.

Sen. Joe Cervantes had put out a sign-in sheet at noon, took three names, then took down the sign up sheet. If you were NOT there by noon, you CANT speak. They have SILENCED your voice!!!!! What kind of BS is this???? Also, the new SB5 ithe same bill was changed at the last minute and is not available  to see! Its NOT on twitter, not online, it's not anywhere!
The moms groups are quite abundant. No word on when the bill will get passed now.

So - the committee meeting has NOT started yet.   The senators are still on the Senate floor.  The new Red Flag Bill is still not online or on twitter.  As soon as they finish with the floor, the are allowed 30 min to start committee.  It's a good thing actually.  **UPDATE** Looks like 5pm now.

Senate bill 5 hearing today was a total crap show !! Passed 6-5.
A amended bill was kept secret and dropped several hours late ! Nobody had a chance to review it ! Testimony was restricted! The room was filled with citizens who oppose this back door gun grab !! Yet they passed it out of judiciary on a party line vote (dem) ... so the next battle will be when the bill goes to the floor for a full senate vote ! Join us this Saturday for one last rally to put pressure on our senators to vote NO !! We can still beat this.
Good news is we flipped one dem so there is still hope :~

Update on what they added in the SB5 bill at the last minute.
From Stephani Lord of Pro GunWomen NM.
I broke down the new 5.5 version of SB 5 that they passed in committee with ALL this new stuff in it. I'm not perfect, so if you see something I missed or didn't get right, please let me know. Thank you.

Pro-Gun Women attempts to break down this new Red Flag Bill and hopefully make it understandable.

Section 2. Definitions of who can file a Red Flag

D. Law enforcement ("Petitioners" that can file for a Red Flag Order) now means police, Sheriff, New Mexico state police, a district attorney, the attorney general.

H. Reporting Party (formerly "Petitioner") is spouse, ex-spouse, parent, current and former step-parent, present or former inlaws, grandparents including inlaws, baby momma or daddy, child, a person you had a "relationship with" (whatever that means), and they ADDED your employer AND a school principle.

So don't make your boss mad! And you better FEAR your crazy ex now! However, we can Red Flag EVERY POLITICIAN since we are their boss.

Section 4. Red Flag Orders

The Red Flag is filed in the county the accuser lives in. So, if you live in Gallup and the accuser lives in Tucumcari, too bad. You still have to drive yourself out there in 10 days to defend your rights.

Section 5. Petition for Red Flag

D. Law Enforcement shall file a petition for a Red Flag Order upon receipt of "credible" information that gives the officer probable cause.

Let's stop here.

"Probable cause is a level of reasonable belief, based on facts that can be articulated, that is required to sue a person in civil court or to arrest and prosecute a person in criminal court. Before a person can be sued or arrested and prosecuted, the civil plaintiff or police and prosecutor must possess enough facts that would lead a reasonable person to believe that the claim or charge is true. The probable cause standard is more important in Criminal Law than it is in Civil Law because it is used in criminal law as a basis for searching and arresting persons and depriving them of their liberty." (1)

In the original ex-parte Temporary Order Proceeding, the judge does not necessarily get to hear facts - it is literally one person's side of the story without hard evidence. There is no certainty that facts are indeed facts before the guns are taken. Unlike a criminal case - hard evidence and an investigation are not needed for a Red Flag Temporary Order or in the hearing. The Petitioner makes up his or her mind and decides (like judge and jury) if they think the Reporting Party is honest or not and that a crime (or harm to self) may be committed in the future. The Petitioner then sends his or her "opinion" to the judge who makes an ex-parte decision without EVER hearing from the accused. They only hear the side of the accusers before the guns are taken, which violates due process.

The problem with this Red Flag Bill is it is not civil; it is not criminal; it is tyranny.

Criminal "[p]robable cause exists where the facts and circumstances within the officers' knowledge, and of which they have reasonably trustworthy information, are sufficient in themselves to warrant a belief by a man of reasonable caution that a crime is being committed." (2) There is no probable cause of a crime committed with the Red Flag Order; instead, the Petitioner has to assume that the Respondent "might" commit a crime in the future, just like the thought police in Minority Report.

D. Continued - probable cause to believe that a person is a significant danger of causing imminent personal injury of self or others. (This is very important as you will see later.)

F. A petition for a Red Flag must be signed under oath. Have you ever known someone to lie under oath? Ya, me too.

Section 6. Red Flag Proceedings - EXPARTE

A. So, now that a Reporting Party or a Partitioner has filed the report, that report goes to a judge. Guess who is NOT there to defend themselves? The accused. The accused has no idea this is even happening at this point. The judge looks at "probable cause" and then decides to issue the order.

Now, let's be real here. What judge in the WORLD is NOT going to push this forward? You want to be the judge that denied an order, and someone actually did do something? No. You will be like the judges in Florida that 90% of the time rubber stamp these Red Flags.

C. Guess when you do get to go to trial? Ten days after your guns are taken.

Now, this is SUPER important. This is civil; you do NOT NOT NOT get a public defender. NO attorney is appointed to you if you can't afford one. And how much will an attorney cost you? Remember, this is NOT to get your guns back. This hearing is to RESTORE YOUR SECOND AMENDMENT RIGHTS! You can NEVER own a firearm again until you defend yourself in court. You MUST have an attorney to protect yourself. And how much will that cost you?

Initial Hearing: $15,000

Appeal: $100,000

Hearing in One Year to Restore Rights: $25,000

Trail costs where give over the phone by Donald Kilmer. Mr. Kilmer is a lawyer and an Adjunct Professor at Lincoln University Law School since 2001. He Teaches:

• Constitutional Law I & II

Constitutional Adjudication
Firearms Law - Constitution, Statutes, Regulations
Attorney Kilmer also testified as a witness and was a contributor to the Judicial Council's Domestic Violence Practice and Procedure Task Force


He has won numerous cases in the Ninth Circuit Court
Here is the break down of the cost to restore your Second Amendment Rights:



Continuance - since no one is ready for a trail in 14 days
Subpoena of Witnesses
Depositions of those that know the accused and the accuser
Hiring a Private Investigator
Medical Expert is $5,000 and up
Section 7. Hearing on the Petition (this is the actual hearing 10 days later)

These are the things the court might look at during the hearing:

C. The Respondent's mental health history.

How are they getting your mental health history? Will the LEO violate HIPPA and have access to it? And what if you are a VET with PTSD? Does this make you automatically guilty?

D. The respondent's abuse of controlled substances.

Does this include medical marijuana since its still a controlled substance on a federal level?

G. The respondent's criminal history like....do they have a Felony? Uh, hello, felons CANT have guns already. Just wow.

Section 8. Hearing for a One-Year Continuance

Remember, this hearing is not only to get your rights back, but if you don't fight? They will issue this order for one full year.

A. The hearing is again based on probable cause, not hard evidence or investigations. You have no attorney, and you WILL need one, and you WILL have to pay for it yourself.

D. You have the right to appeal. Guess how much that will cost you in legal fees? $100,000 in the court of appeals.

E. One month before the year being up, the Petitioner or Reporting Party can file ANOTHER petition, and guess what? You get to go to trial again. And how much that will cost you in attorney fees?? $25,000.

Section 10. Relinquishment of Firearms

A. Are you ready for this new amendment? Remember, I said that there is supposed to be "probable cause to believe that a person is a significant danger of causing imminent personal injury of self or others" to issue the Red Flag? Well, guess what? (And on a personal level, I do NOT want the democrats to amend this portion at all. It shows the bill for what it is - a gun grab.)

Instead of the Sheriff serving the order and taking the guns like in all previous RF bills, the Respondent now has TWO DAYS to surrender the guns!

But wait, I thought the entire purpose of the EMERGENCY RED FLAG PROTECTION ORDER was to do something NOW and to save lives by taking the guns away? That's what the anti-gunners have been PUSHING for the past year - to "save just one life." Now it's not important? Am I taking crazy pills because this was the point of this entire unconstitutional bill from the start; assume you are guilty, take your stuff NOW, and then later you can have a quasi trail.

** The anti-gunners showed themselves to LIARS about this bill. Its been a SHAM the entire time! They don't want to "save one life" they just want to take "one gun at a time" from the American People. **

Section 11. Penalties

Btw, if you get busted with a gun while the order is in effect, its a misdemeanor.

Section 12. Reporting to NIC system

A. Guess what happens if you are falsely accused, or you get your rights restored? You get to hire ANOTHER attorney in a federal case to get your name cleared in the NIC system. And then guess what? Read on....

Section 13. Firearms Returned

C. BEFORE you get your firearms back, you MUST pass a background check. Guess what? If you didn't get your name cleared in the system? You DONT get your guns back. Back to paying for an attorney.

Section 14 - They ADDED a Liability Section

I am no Tort Law Attorney, and I will need help with this section

41-4-12 Liability LEOS

The immunity granted in subsection A of section 41-4-4 of NMSA 1978 does not apply to liability for personal injury, etc.. and underlined is "failure to comply with duties established pursuant to statue or law" to deprive a person of rights, etc.

Section 15. Maximum Liability

Liability shall not exceed:



200,000 for damage to property
1,000.000 for medical bills
1,000,000 other things
2,000,000 max total liability per claim
I don't know if this means you can sue the police if they do any of the following while serving you the order? But what I would RATHER see is $2,000,000 awarded for FALSE accusations by Petitioners and/or Reporting Party.

These are the 22 Senators that voted for Red Flag.
The BIGGEST traitor on this list is Munoz from Cibola County.  Their Sheriff is Tony Mace and Munoz KNOWS FOR A FACT his constituents did NOT want this Red Flag bill; he went against them anyway.
