Title: BATFE gives up on M855 5.56x45 ammo ban, for now

"further study"     is BATFE-speak    for

"until you peons turn your attention away for 2 seconds and we can stick it to you,  again"

note that they haven't rescinded the import ban on ex-soviet 7N6 5.45x39  ammo, which is falls into the same class as M855

Wisconsin congressman Jim Sensenberener introduced a bill to disban the batf last week.  Maybe that played a part.

many thanks to all of the 80,000 folks who took the time and effort to notify ATF of their mistake.
Your calls letters and emails no doubt helped them determine this action was not a good idea .

In addition to the individuals who added their input, a word of thanks to Rep Goodlatte of Virginia who collected 230  fellow congressmen signatures in opposition. Mr Goodlatte further stated if the ban was to go through he would cut funding to the agency . Good job Congressman Goodlatte and thank you voters of Virginia who elected him.

The senate also deserves a word of thanks too. Iowa Senator Charles Grassley also obtained signature s from over 50 US senators in opposition to the ban on green tip ammo. Thank you Iowa for electing Senator Grassely .

Last but certainly not least we all owe a word of thanks to Wisconsin Congressman Jim Sennenbruner who threatened to actually disband ATF over this tyrannical ammo ban.  Wisconsinites  who elected Congressman Sennenbruner we are in your dept.

Its tyrannical  that we have elected politicians who direct fed agencys to attempt to implement gun control by banning ammo.

Laws are supposed to be written by congress.

Those who fail to study history are doomed to repeat it.

This was nothing more than a probing attack.  They probably didn't even expect it to work, but rather sent it up as a trial balloon to see what the reaction would be and how to try again with better tactics in the future.  With any luck, the overwhelming response will set them back on their heels a bit, but rest assured, they will try again.

Tyranny never sleeps. Historically, politicians and tyrants alike, always prefer their peasants be barred the use of arms.

"Guard with Jealous Attention the Publik Liberty. Suspect everyone who would approach that Jewel. Unfortunately, nothing but downright force will preserve it. To give up that force is to be ruined" Patrick Henry - VA Ratification Convention 1787

The above was offered as an argument for the Second Amendment. Most thought it unnecessary as it was too obvious. Patrick Henry believed a time would come, as it always does, when the Natural Right to arms would not be seen as obvious.

Evil will always walk the earth in the hearts of men. Nothing gives evil pause but brute force - a sad reality of the nature of some humans.

Cesare Baccaria - Essay on Crimes and Punishments 1809

Translation:
"A principal source of errors and injustice are false ideas of utility. For example: that legislator has false ideas of utility who considers particular more than general conveniencies, who had rather command the sentiments of mankind than excite them, who dares say to reason, 'Be thou a slave;' who would sacrifice a thousand real advantages to the fear of an imaginary or trifling inconvenience; who would deprive men of the use of fire for fear of their being burnt, and of water for fear of their being drowned; and who knows of no means of preventing evil but by destroying it.

The laws of this nature are those which forbid to wear arms, disarming those only who are not disposed to commit the crime which the laws mean to prevent. Can it be supposed, that those who have the courage to violate the most sacred laws of humanity, and the most important of the code, will respect the less considerable and arbitrary injunctions, the violation of which is so easy, and of so little comparative importance? Does not the execution of this law deprive the subject of that personal liberty, so dear to mankind and to the wise legislator? and does it not subject the innocent to all the disagreeable circumstances that should only fall on the guilty? It certainly makes the situation of the assaulted worse, and of the assailants better, and rather encourages than prevents murder, as it requires less courage to attack unarmed than armed persons."[4

Funny thing is, all they really need to do is to remove the specific exemption on M855 in the ATF Regs.

M2 AP (30-06 Black Tip) and M855 (5.56 Green Tip) have been specifically exempted from AP ammo bans. That's by name/model number.

That said, doing that (trying to ban M855) carries a terrible consequence.

Especially when it doesn't meet the criteria for the original AP ban anyways. Caliber and content are inconsistent with the regulations.

But, it was nice of them to consider it. Because of the "ban" attempt, I sold a lot of it at shows. 33 boxes in one weekend, at a real small show, and to just 3 customers. One bought 13 boxes, the other two bought 10 boxes each.

Those of us who contributed to the outcry over M855 (and even those who didn't) should be doing the same thing to help roll back the 7n6 overreach, as well.

Agreed. They will come after the ammo for "assault" rifles, then expand from there.

You're right on that one. The Branch Davidian raid was set up as a PR stunt to justify the existence of an inept agency. It was codenamed "Operation Showtime" and had reporters with cameras in place shortly before the raid took place.

Yep, and before Waco, there was Ruby Ridge. The sniper that killed Vicki Weaver was present at Waco, as well.
April 19 is a memorable day for multiple reasons.

Not if you're a dealer selling ammo. Type 06 FFL (ammo manufacturer).

based on the rationale that any rounds usable in a pistol that will penetrate kevlar must be banned, they can go after anything. Thompson Center pistols have barrels available in every imaginable caliber, therefore pretty much any centerfire rifle ammo can be placed in the banned category. And let us not forget the 7.63 Mauser/7.62 Tokarev fmj round, on the market since 1895. Tests show it punches holes in kevlar level II. . Not too shabby for a pistol cartridge 120 years old.

ATF has specifically qualified it as "multi-shot pistol", but I got a sneaking suspicion that they count two shot derringers in that. 30-30 and .45-70 aren't even safe.

and that makes it one  BATFE  political appointee  reinterpretation away from being  changed to give them what they want, what they always want, more and greater restrictions

disassembled rifle parts kits minus receiver  were  good to import w/ barrels until BATFE reinterpreted their regs a few years back

ex-Soviet 7N6 5.45 ammo was good to  import  until BATFE reinterpreted their regs last year

M855 was good to go until last month when they took another look at those regs

or perhaps I should blame the regs,   seems  those darn things are as flexible as Gumby,  they incessantly demand constant review, revision, and reinterpretation

curiously, it  always leads to less liberty

BATFE does not have a good track record in the    "I can trust them"    department.

One huge obstacle to be surmounted is that M855 projectiles do not meet the requirements of the law, and therefore, the exemption is irrelevant, as it just flat out doesn't apply anyways, as the projectile doesn't meet the requirements of the ban in the first place.

Add that M855 accuracy sucks compared to bullets that have no lead core, and you'll see the only reason I care is this becomes a very slippery slope.

And, if you check the regs on ATF's website, it was still exempt as of 3/7/2015, when they printed the new Federal Regulation manual.
